1. Agreement to Terms

By accessing or using Health Companion 360 ("Platform," "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.

These Terms constitute a legally binding agreement between you and Health Companion 360 Private Limited ("Company," "we," "us," "our").

2. Description of Services

2.1 For Patients (Free Service)

AI-assisted symptom analysis to identify appropriate medical specialty
Discovery of nearby healthcare providers based on location and specialty
Ability to send inquiries to clinics
Review and rating of healthcare providers

2.2 For Clinics (SaaS Platform)

Profile creation and management on the platform
Patient inquiry management dashboard
Analytics and performance metrics
Subscription-based features with tiered access

3. User Obligations

3.1 Patients

Provide accurate information when describing symptoms
Use the AI classification as guidance only, not as medical diagnosis
Always consult a qualified medical professional for health concerns
Not misuse the inquiry system for spam or fraudulent purposes

3.2 Clinics

Provide accurate and up-to-date information about your clinic and services
Respond to patient inquiries in a timely and professional manner
Comply with all applicable medical regulations and licensing requirements
Not engage in misleading advertising or false claims
Maintain patient data confidentiality as required by applicable law
Comply with the DPDP Act 2023 when processing patient data

4. Subscription and Payment Terms

4.1 Plans and Pricing

Free: ₹0/month — 10 inquiries/month
Basic: ₹499/month — 50 inquiries/month
Premium: ₹1,499/month — 200 inquiries/month + priority listing
Enterprise: ₹2,999/month — Unlimited inquiries + all features

4.2 Billing

Payments are processed via Razorpay
Subscriptions auto-renew monthly unless cancelled
No refunds for partial months; cancellations take effect at end of billing cycle
Prices may change with 30-day advance notice

5. Intellectual Property

All content, trademarks, logos, and software on the Platform are the property of Health Companion 360 Private Limited. You may not copy, reproduce, modify, or distribute our content without prior written consent.

6. Disclaimers and Limitations

6.1 No Medical Advice

THE PLATFORM DOES NOT PROVIDE MEDICAL ADVICE. The AI symptom analysis is for informational purposes only and should not be relied upon as a substitute for professional medical judgment, diagnosis, or treatment.

6.2 Limitation of Liability

To the maximum extent permitted by law, Health Companion 360 shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or reliance on information provided herein.

6.3 Clinic Responsibility

Clinics listed on the Platform are independent healthcare providers. Health Companion 360 does not endorse, verify medical credentials of, or guarantee the quality of services provided by listed clinics.

7. Prohibited Conduct

Using the platform for any illegal purpose
Submitting false or misleading information
Attempting to breach platform security
Scraping, crawling, or automated data extraction
Impersonating another person or entity
Using the platform to harass or harm others

8. Termination

We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our discretion with reasonable notice. Upon termination, your data will be handled per our Privacy Policy.

9. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Disputes shall be resolved first through mediation, then through arbitration in Mumbai, India, under the Arbitration and Conciliation Act, 1996. Courts in Mumbai shall have exclusive jurisdiction.

10. Changes to Terms

We may update these Terms periodically. Material changes will be notified via email or platform notification with 30 days advance notice. Continued use after the effective date constitutes acceptance.
